Intellectual Property/Brand Protection Services

In the current digital environment, intellectual properties can be increasingly difficult to protect from infringement. It has become easier than ever to duplicate and distribute another’s rightful work, regardless of copyright or trademark.

However, there are legal responses to address this type of activity, and Kreller Group offers a distinct service for companies and other entities that want to respond.

Intellectual Property: Infringement Discovery
For organizations or individual that may suspect their intellectual property has been appropriated. Kreller Group will search and monitor websites for counterfeit or infringing products.

If unlawful attribution and use has been identified, we will:

  1. Take necessary steps to have notices sent to all websites where counterfeit/infringing products are being sold to remove the properties in question.
  2. Identify, locate and verify companies in foreign countries that are manufacturing or distributing counterfeit/infringing products. This includes having an investigator/agent purchase product(s) from infringing companies.
  3. Find and manage vendors that can file trademark/patent applications in foreign country where counterfeit/infringing product(s) are being manufactured/distributed.
  4. Gather and organize evidence of infringement that can be used in civil litigation or enforcement proceedings in foreign countries.
  5. Take necessary steps to alert the US ITC, US Customs and Border Protection and other US agencies that a foreign company is distributing infringing product(s) into the US.
  6. Find and manage law firm in foreign country that can file civil litigation or enforcement proceedings in foreign countries.

Intellectual Property: Infringement Response
If an organization or individual has evidence or knowledge that their properties are being sold without their knowledge or lawful attribution, Kreller Group will:

  1. Search to see if there are other websites that are also selling counterfeit/infringing products.
  2. Take necessary steps to have removal notices sent to all websites where counterfeit/infringing products are being sold.
  3. Identify, locate and verify companies in foreign countries that are manufacturing or distributing counterfeit/infringing products. This includes having an investigator/agent purchase products from infringing manufacturers or distributors.
  4. Find and manage vendors that can file trademark/patent applications in foreign country where counterfeit/infringing products are being manufactured/distributed.
  5. Gather and organize evidence of infringement that can be used in civil litigation or enforcement proceedings in foreign countries.
  6. Take necessary steps to alert the US ITC, US Customs and Border Protection and other US agencies that a foreign company is distributing infringing product(s) into the US.
  7. Find and manage law firm in foreign country that can file civil litigation or enforcement proceedings in foreign countries.

The time and cost required to create intellectual properties is a serious investment – and Kreller Group can help ensure that the benefits and profits remain solely with the rightful and legal owner.
